Know Your Rights - Immigration Enforcement

Important Message from President Martha Garcia's Email Communication on 1/22/25

Mt. 91直播 policies, procedures and practices are designed to protect the rights of our students and to fully support them in their academic pursuits. California law guarantees protection against discrimination and harassment for all members of our college community. Additionally, Senate Bill 54 and AB 21 provide critical protections ensuring that our students can pursue their education without intimidation or undue risk. We firmly oppose any efforts to diminish these protections. Mt. 91直播 does not and will not participate in federal immigration enforcement unless legally required. Any personally identifiable information related to immigration status will only be shared if mandated by a judicial order.

    • Know Your Rights Red Cards 

      All people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution. The Immigrant Legal Resource Center鈥檚 (ILRC) Red Cards help people assert their rights and defend themselves in many situations, such as when ICE agents go to a home.

    • Know Your Rights Resource Library

      Everyone in the U.S. has certain rights guaranteed under the U.S. Constitution, regardless of your immigration status. You can鈥檛 always control whether you will come in contact with immigration or law enforcement. It is important to know and practice these scenarios so that you and your friends, family, and colleagues are prepared for any situation. Understanding what your fundamental rights are and how to use them will help you advocate for yourself and respond appropriately if you encounter the police or immigration enforcement.

    • Family Preparedness Plan

      Every family should have a Family Preparedness Plan in case of an emergency. It is critical for immigrant families to think ahead and set more concrete plans for immigration emergencies that can arise. For example, this Resource Toolkit goes into detail about different childcare options available in case of an absent parent, where to find trusted immigration services in your community, and how to prepare to assert your constitutional rights in the presence of an immigration officer. 

      is divided into different sections that give guidance on family preparedness planning, regardless of immigration status. It gives additional advice to undocumented and/or mixed status families. 

    • "We Have Rights" Videos

      An empowerment campaign to prepare for and safely defend our rights during encounters with Immigration & Customs Enforcement (ICE). The videos are available in closed captions. 

    • Rapid Response Networks

      Rapid response networks in California respond to Immigration and Customs Enforcement (ICE) detentions and raids in our communities. Many counties have a local rapid response hotline available 24/7. 

    • Know Your Rights App Download

      If you find you have to deal with I.C.E. or other law enforcement officers at home, on the street, or anywhere else, it鈥檚 important you know and practice your basic rights.

      Access information about your rights and legal resources. Once you have opened the KYR app, please scroll down to select one of 16 languages available. In the case of an emergency, announce your rights in English and send a text to a preselected list of contacts.

    • Free Immigration Legal Services

      Free immigration legal services and case support for students, staff, and faculty on California community college campuses. Appointments are available in-person or virtually.

      Know What to Do

      Follow these steps if a federal immigration official is on campus and requests access to student information, district records, or entrance to a facility.

       
      Step 2

      Remain Calm and Professional

      91直播 and its employees must follow state legal procedures and Mt. San Antonio Community College District policies.

      Step 3

      Ask for ID and Communicate

      Ask the official to identify themselves by their name, identification number, and agency. Politely inform the officer that you are not obstructing their process but you must refer them to the proper office for guidance and assistance.

      Step 4

      Notify the Human Resources Office

      Contact the Human Resources Office (HR) at 909-274-4493; Building 4, open Monday-Friday 8:00 a.m. - 5:00 p.m.
      Outside of HR hours, contact Mt. 91直播 Police and Campus Safety at 909-274-4555.

      **Warrant verification and subpoenas are required and must be verified by the Human Resources Office**

       

      Frequently Asked Questions

      Q: Can I release student information to law enforcement officials?

      No.  Any release of student information to law enforcement must be authorized by the 91直播 President/CEO.  Student information is governed by the Family Educational Rights and Privacy Act (FERPA) and Mt. 91直播 Board Policy and Administrative Procedure 5040-Student Records, Directory Information, and Privacy.

       Q: Will the Mt. 91直播 Police and Campus Safety enforce federal immigration laws?

      No. Mt. 91直播 Police and Campus Safety Officers do not have access to student immigration status.  Mt. 91直播 Police and Campus Safety will:

        • Not enter into agreements with law enforcement agencies or federal departments for the enforcement of federal immigration law
        • Not honor immigration hold requests
        • Not contact, detain, question, or arrest individuals solely on the basis of declared or suspected immigration status

       Q: Since Mt. 91直播 is an open campus, can law enforcement officials access all areas of campus without permission?

      No. Although Mt. 91直播 is a public institution, there are areas on campus that have limited access, including classrooms, locked offices, or areas marked as 鈥渁uthorized personnel鈥 that cannot be accessed without official District permission.

       Q: Are there different rules for international students?

      No. Mt. 91直播 campus policies also pertain to international students.
